It depends on where you live. In some states you only need one of the people to consent to having something taped. A good example of this when the police do undercover operations and have the undercover officer wear a microphone. It should be noted that information can be used in a court of law.
Keep in mind though that some states, such as Illinois, require both parties to consent to being tape recoded

you need to look up the laws in your state and the state that thre other person lives in and follow the strickter of the two laws but yes it can be done but will the Judge allow it? There are twelve states that say all party's must know and the rest are one party. if you cross state lines then you must follow the strickter or the fed laws.

depends on the state.
the law in my area (Texas) states that at least one person in the conversation must be aware of being taped. that means you can tape yourself having a conversation with another person BUT you cannot tape 2 (or more) other people in conversation with each other when none of the other parties have been made aware that they are being recorded. (that is a felony)

In CA a person can tape any conversation they are a part of or any conversation they can hear when they are in a legal place.
If I'm talking with a group of guys I can tape it.
If I'm next tio a group of guys, and they're so loud that I can hear it, then I can tape it.

I'm in NY and I believe that as long as one person (the recorder) is aware the conversation is being taped, then it is legal.

Depends on the location some states allow it (like Oregon) others (like Washington) require the person being recorded to know they are being recorded. Other states don't allow any type of recording of people.

it was my understanding that it was illegal without the person's permission so it would not hold up in court..however it can be handed over to the police to convince them to do an investigation of illegal activity..
I have heard cops (I was around them a lot as a kid) tell people to tape record people for evidence that they could use in an investigation...
