I was rear-ended. His insurance was being difficult so I went through my own. However, the mechanic who did the estimate on my car had it ready the week of the accident. My insurance company didn't approve my car to get fixed until three months after the accident. I ended up spending close to $3000 in car rental fees. I've asked my insurance to reimburse me because they failed to follow through on the approval. But they refuse. Can I sue them for this?

His insurance is responsible for your rental unit, since most only cover x amount a he is responsible for the rest, this is the case if you rented something comparable to your car, if you had a honda for example and rented a big SUV you are responsible for the difference

If you went through your own policy, your company is going to pay out what your rental coverage provides on your policy. If your car was done the same week of the accident, why do you have a $3000 car rental bill? If you file through your own policy, you are responsible for your deductible and whatever percentage your policy states for car rental reimbursement. Once the claim is cleared up with your company, they will subrogate against the claimant so they can get reimbursed. If they are reimbursed, the company is required to pay you back your portion of the deductible and any REASONABLE expenses that you occurred. It is not likely that you will get all of the $3000 back. Suing probably won't do you much good. Most lawyers will only take accident injury claims.

Hmm.. im sensing that there is more to this story......
First off.. you can sue anyone... its whether you win thats the problem.

Now.. of course your insurance would be in the wrong if they just waited like 3 months before doing an initial estimate.... that is.. IF you told them from the beginning you wanted to go through them.

Now.. they would NOT be int he wrong if you got repairs done before they approved them (aka- you had your mechanic do the wrok before they could do the estimate)- mechanics must work of insurance estimates.

So to make a long story short.. please provide more details and i can help you more. You MAY and i repeat MAY have a fighting chacne if they truly just ignored your car and didtn do a thing for three months..

but alot of people dont realize that they were the problem and then they blame it on the company

My policy will pay a maximum $1000 for rental car. Your policy, if you have rental car coverage, probably has a maximum it will pay. I don't think you'll get a dime more from them.

You can sue anyone for anything .
Will you win is another question .
Find a lawyer that only charges if he wins .He can tell you if you have a chance .
