Can a cop put his hands in a persons pockets without consent from the person being searched with no handcuffs on and no pat down?
Also can they arrest someone who they already let go then they say is a witness?
and dont they read you your rights as soon as they arrest you not when they reach the police station?

Ok see what happens because this sh*t has happened to me >.>.Like they check you for weapons,drugs,etc.(the pocket ordeals)

The whole entire release then catch your *ss yes because once agian happened to me.

And its actually agianst the law if they do not say your rights.So actaully the pig that nabbed you.You can go right back around and get him fired and thrown in jail.

Yes. If police find evidence linking someone they eariler let go from suspicion/questioning to a felony crime, they can track down and arrest the suspect.

Yes. We can search you whenever we feel like or safety is jeprodized. Furthermore we can search you if we have suspicion that you are carrying something illegal on you.

Id say if he just stuck his hands in your pockets it wasn't safety, he probably had reason to suspect you were carrying something illegal.

I already answered that. They could tell you that you were the mother of God and ruler of the universe and then arrest you. Police officers are not required to tell SUSPECTS the whole truth and nothing but the truth. They told you that you were a witness so you wouldn't break down crying or wouldn't get combative. Best to just keep everyone calm until the investigation is over.

It doesn't matter when your rights are read to you. But if you admit anything before your rights are read to you it can not be used against you in a court of law. Furthermore there a exceptions. If the officer feels you are incapable of understanding your rights (you're intoxicated, impaired, handicapped, particularly young, etc) they do not have to read you your rights at all.

1. No, he has to tell you he is going to search you, and in some situations get your consent.

2. They con not arrest someone if they are only needed as a witness.

3. They HAVE to read you your Miranda rights as soon as you are arrested, otherwise, you can have any conviction that may occur overturned.

a police officer has the right to search, pat you down put his hands in your pockets whether you are handcuffed or not anytime you are in public as long as he is telling you he is going to search you...yes they can ...but i dont know why they would arrest a witness most of the time it is called detainning a witness...they are required to read you your miranda rights the minute you are arrested unless...you are in no shape to understand them...such as drunk or high...or your life or their is in immediate jeopardy and you need to be removed for yours and their safety...

When you are being searched, the police can search anything they want...

Yes, you can be re-arrested as a witness - if you are particularly resistant.

Yes, you must be read your rights BEFORE formal questioning.

1. yes this is a pat and frisk type search supposed to be only for weapon
2. yes for any reason including if they find out new information
3. you never actually have to be read your mirnada rights. they only have to give them to you when you are in custody and before they question you while you are in custody. so no custody or no questions no need for miranda. if they never question you you don't have to be read your miranda rights. yes totally fine not to do it at the scene.

it much depends on how he answered the police questions
if he claimed his us citisenry right yes [or gave any of the legalities ie drivers licence rego cert, a post code or clam to be a citizem

The police have guns. They can do anything they want. If you don't like it, you have to prove they did something wrong in a court of law.
