Me and my "other" are going through a custody battle for our son because he has to go to school in the fall (he will be 5). We have shared him 50/50 up untill now.

I want to know if I should go ahead and enroll him in school for the fall, or if the courts would look down on that as I am expecting to have custody?

He needs to go to school regardless. I can't see how taking care of his needs can be construed as anything negative.

By all means you enroll him in school. Do it because it's the right thing to do, regardless of the court outcome.

My ex had custody of my son and hadn't enrolled him in school yet when she(we) decided he would be better off living with me, and I had to scramble at the last minute and pull in a few favors to get him in the school I wanted.

First of all, I think it is great that you two are sharing custody 50/50. It's not your childs fault that ya'll are getting divorced so he shouldn't have to suffer either. Maybe y'all can continue to work it out as far as custody goes for your childs sake.
Try counseling even if it only benefits your son. Who knows, maybe counseling will show both of you that y'all can be friends after divorce. Good luck!

My father shared 50/50 custody with my step sisters, their mother lived in another county, they were enrolled in BOTH schools. When they were with my family the went to the school in our district, when they were living with their mom they went to the school there. You need to talk with the schools to make this type of arrangement but it worked out quite well for my step sisters.

i would think that would make you look responsible. that you are looking ahead to secure his spot for his education not just waiting to see how it goes. i would do it.
