The first thing you need to do is to file a FORM 14 Family Access motion. It matters not if you were married. THis form is REQUIRED before any subsequent action may be brought before the family court.

Next you will need to complete a financial disclosure of assets and income. Normally, you can get these forms from the Jackson County courthouse either in downtown Kansas city (Jackson County Courthouse. 415 East 12th Street, 2nd floor Kansas City, MO 64106 (816) 881-4239 (816) 881-3983 ) or by visiting one of the suburbs such as Independence where the courthouse is two blocks from the square. (Independence Courthouse located at
308 West Kansas)

You will also need a proof of service (with instructions) form so that you can provide the ex with a copy of the petition filing.

Family court in the county court system you live in (I know KC sits across a couple of counties.)Call the clerk of court tomorrow and ask where to file a petition for custody.

It's not really something you should be doing without a family law attorney, it's a tough thing to get right as an amatuer. Just letting you know, I'd get a lawyer to do it and you'd have a much better chance of actually winning.

You need to hire an attorney. Although you can potentially do this yourself, it is NEVER advisable. If you screw up, you may lose all your chances of getting custody in Kansas City.
