We have told our landlord we intend not terminate our lease which is due to expire on 26th July, He says we must give him 60 days notice and that the lease is on a month on month basis after the initial 6 mnths. Is this legal?? do we need to give 60 days notice?? Can we terminate after the lease end date??

Check your lease for the term of you lease if it was 6 months it will be over so he can choose not to renew. The notice will depend on your state laws in this state it is 20 days but you must notify by the 10th of the month.
Being month to month he can raise the rent any time and you can leave anytime with about a month's notice on either side.

It depends entirely on what the lease says. Get out your copy.

Okay, the lease expires on July 26th. Does it say how many days' notice is required to extend the lease beyond that point? (In most places, at least 30 days' notice is required, and it's already less time than that.) Does it say tenancy is on a month to month basis after a certain time period or date? When?

That lease is the only thing that spells out what your rights and obligations are. Anything he said that's not in the lease might as well not have been said at all, even in front of witnesses. The courts recognize only the lease.

Unless you want to show the lease to a lawyer and pay for his advice, my advice is to start apartment hunting and pack up, so you'll be out by the 26th. It sounds like your lease is up on the 26th and your landlord is not obligated to renew it--and doesn't want to.

First off it depends on what state you live in. But for California you have to give 30 days if you have a lease, and 60 day if you are month to month...hope this helps. I just went and did all this..even looked up laws. Sometimes you can get prorated so you do not have to stay as long...and get some money back. Hope this helps, and good luck. Also bring in your lease agreement....
