can i basically just by the phone to replace my old phone. without having to start a new contract?

I'm sure you can. It's just going to cost a LOT more that way.

I believe it's against federal law to prohibit the sale of a communications device without a contract. And because of that, it's why you can buy them at eBay and other places -- the iPhone 8GB version is currently listing at eBay for anywhere from $450 to $950 -- it's going to be hilarious to see what some will pay.

You might be able to go halfway -- sign a one-year and get some price break...

If you are an existing AT&T customer, you have to check with them -- some people are able to while others are not... it depends on your current plan. Check out the iPhone Discussions pages:
