I'd like them to leave. The relationship has gone sour and they have damaged our property. When new prospective landlords call, can I be evasive? Can I just say they paid their rent? Can I lie? No one is going to want them if I tell them this.

Our tenant always paid their rent about 20 days late. We are so glad they are finally leaving. Do we have to tell prospective landlords this? What do we say when they call us for rental history?

You're story is one of the best reasons why it's usually not a good idea to check with the most immediate past landlord. They will typically lie to get rid of bad tenants.

You're must better off to call the one before the last and if possible, another former landlord.

You're not giving a statement under oath, so you won't be committing perjury if you're untruthful to a prospective new landlord.

However how would you like the same treatment if you call for a reference?

Let your conscience be your guide.

I'm also a landlord and I always answer truthfully about former tenants; someone else will be brave enough or foolish enough to rent to them.

PS, tenants always have great stories to tell new landlords about why they're moving and why they may have been "just a couple of days late" with their rent. It's sort of like the old "I only had two beers your honor" story drunk drivers tell the judge.

Well, you aren't any better if you want to victimize someone else with your dishonesty.

Just tell it like it is, "they always paid their rent, but were late on occassion".

There are some landlords with just one property. They have to pay the mortgage no matter what. You could put those people at risk of loosing their property if you are dishonest. Others will not really care as long as they are paid.

Only answer specific questions. Did they pay their rent? Yes. Did you evict them? no What type of renters where they? Did not associate with them. etc, now if they ask was their rent paid on time? Usually although there where a few instances where they where a little late. Keep away from specifics but be honest and don't give up more that asked, this way you do not hurt them, yet keep your integrity.
