My husband and I are seperated and he is in Iraq he has a son with me and a daughter from a previouse relationship. I was wondering I was told I am entitled to all of the BAH but he says I am not since he has two kids. Does anyone know if that matters since our son is through marriage and his daughter is not and he gets the BAH because he is married and kids.

Ok I don't think ppl are understanding my question I know I am entitled to benifits and all this I know a lot I am asking am I entitled to all the BAH even if he has a kid not threw marriage who he is already payting child support on.

This exact same situation happened to me 3 years ago. I did not know anything about military benefits at the time but my husband was stationed near our home prior to deployment and had previously began to be extremely abusive to me and our child. Through the legal system, I was referred to the JAG office at the military base where he was stationed and that was when I was informed about BAH. The JAG officer specifically asked me if I was receiving BAH and I told him I did not know what that was. He said that my husband was only receiving that income because he was married with a child. As a result, the JAG officer contacted my husband's commanding officer, who in turn contacted my husband, and basically told him he either had to give me and our child the BAH or he would not receive it at all. My husband was furious but the military forced him to give us that amount during the time that he was deployed (18 months). I hope this helps you. I understand how difficult this can be. Take care.

Yes you are entitled to all of his BAH because you are still married, and also because you have temporary custody of both of the kids right now. Once you finalize any kind of divorce you will only be able to receive child support. That is a percentage of his base pay. Hit me up

Both kids get benefits because of their father being in the military. You also get some benefits because currently you are married to him, but once you are divorced, you will no longer have medical coverage, or housing rights.
You will be allowed to come on base if the child is still under his health plan, and the child is seeing a military physician.
You need to get in touch with your ombudsman for a list of phone numbers you need to contact, if that information was not provided to you already before your husbands deployment.

Military wife here, let me clarify your situation about the benefits that a wife can have, first of all the only thing that we can have from them,no matter what branches it it, we get Defendant military ID, privilege to use it for post or navy exchange and commissary, health benefit, monthly allotment depends on your husbands rank. Now for the rest of it your husband gets housing and food allowance,esp. if his traveling and in Iraq. Wife is not allowed to get full BAH,husband do. You have this benefits because of your husband.
and if you and your husband will end up being divorce the only benefit he can give you is for your son only till he reach legal age that is all....

if he has first child on the DEERS program he must split the BAH 50/50. if not you receive all of the BAH. BAH is for the dependant and it is punishable by the UCMJ if you are not receiving it while separated. the military only reconize dependants enrolled in the DEERS program.you can go to JAG to receive the legal separation paperwork.if his other child is not on DEERS he must pay that support from his salary and give you all of the BAH

I think that's a good question....but sorry I don't know the answer.....what is BAH anyway....I'm divorced from a navy guy, and have 2 kids with him and I don't get crap.....I love how they say they take care of the families....I have been divorced for 14 years and let me tell you that is bulls**t...they don't!!!! you are entitled to bah until you are legally divorced. can you get proof of him cheating? then you can provide this to the commander, and actions will be taken. (ucmj) if they do not help you, then go above their heads. depending what hes in, batalion, division, go to the next higher up and continue to do so until you are helped. you have WAY more rights than you are realizing. this chick is not entitled to anything. trust me. now if and when he marries her, thats a different story. have you talked with the rear d commander? they will usually help just so you know, you cannot divorce him while he is deployed

I'm pretty sure you should be getting BAH. Call a legal department and/or family advocate office and get the story from the proverbial horse's mouth.
