this could be a delicate concern. It quite often relies upon on the officer, his command, what provisions the UCMJ makes for civilian interactions. the fast answer is sure, he will probable go through extra for no longer only bringing a knife to a fist combat, yet assaulting a US Officer with a risky weapon. He replaced into easily interior the incorrect right here. Had they only fought it out, they could have spent the night in reformatory (or only left if no person referred to as the police officers), yet breaking out the blade is going to cost him. it rather is too variable for specifics yet he can anticipate to be charged with attack with a risky weapon no less than. The officer additionally gets an NJP or Courts Martial for habit unbecoming, and Article 134 (the seize all). he's likewise an officer, so they gained't pass easy on him, there's a sturdy probability they're the two screwed. each and each state has it rather is very own regulations with regards to sentencing, yet he can anticipate a skill 10 years, according to probability much less if it rather is a prevalent offense, extra they suspect he easily all started it. His terrific protection, rather his only protection, is he replaced into dealing with a extraordinarily experienced committed killing gadget and extremely almost easily replaced into justifiably afraid for his existence, or a minimum of his ***. He needs to make an apology and settle for that they the two went too a techniques and it have been given out of hand, in the event that they are able to reconcile in front of the media, it could pass very much extra valuable for them. As a Marine, i replaced into an inch faraway from a matching concern one time the place I had the experience to take a beating fairly than gouge out a under the impression of alcohol civilians eyes. I hate that guy to in the present day, yet i'm happy he's no longer blind :-)

They can pull anything out of their rear. If you feel you have a reason to complain, file a grievance and have the department investigate it.
Giving a cop what he asked for is not always punishable.
Take the case in New Hampshire, where one mazed a driver after a car chase. Now, the driver was in the car, controlled, and the cop was just angry. He walked up to the car, sprayed him in the face, then walked away. The driver reacted by pulling a gun and shooting him 6 times. Then, running over his body twice with his car. The driver was recently cleared of all charges, the incident thankfully on tape.
So, sometimes they do ask for what they got.

Just what exactly did the officer say you did to him? Because, depending on what you did (or did not do), you may have assaulted him...Just because you're handcuffed doesn't mean you didn't assault him.
You'll have your day in court...Thats when you (and your attorney) can fight it.
And the punishment for Assault on a LEO is usually 1yr+...unless it is a first offense...then you might get by with probation, etc.

So how does it say you did it in the police report? Did you kick him? Or headbutt him? Or spit on him? I almost got that same charge along time ago for just jerking my arms away from a cop while in handcuffs.(I was drunk). If you DID do something they will ALL remember your face and then....... ahhhh, nevermind. GOOD LUCK !

Aggravated assault on an officer is a felony, meaning prison for one year or more.
Different jurisdictions have different sentencing guidelines.
Speak to an attorney...

There is no punishment for 'apparently' doing anything. If you are convicted of assault, you will be punished for assault. If you are not, you will not be sentenced.

What ever you get won't be enough for assaulting a person who one day may save your life.
