i got a misdemeanor for possession of under a gram. that was 3 days ago. the date on my citation paper says to appear in court on august 30th. is there anyway i can appear in court for the case earlier, reason i would like it earler is because im gona be having surgery in mid august and might be hospitalized for 10-15 days.
i need help.

probably not. you were most likely given the earliest date possible. you can, however, get it delayed.

dang. charged for under a gram? of pot, or something white? around here if it was green you would never have been charged unless you're a minor. good luck.

You need to contact the court and explain that you may still be in hospital at the time of your court date. They will then set a new court date for you.

if you can prove you may be in hospital they will delay your hearing.

It is unlikely that they will bring the date forward. The date they have given you will be the earliest your case can be heard.

Remember though your reason for asking for a change in date has to be a legit provable 1.

Contact the Clerk of the Court and tell him or her your circumstances. The Clerk's office usually controls the trial calendar.

usually court dates are pre-set, at least they are in my jurisdiction. the best thing to do is contact the courts and tell them your situation and ask for a continuance. tell them you can provide documentation to support your claim. usually this will work.

write to them enclosing all medical correspondence-a letter from your doctor (physician) will normally help. they should at least consider re-arranging the hearing.
