The child, and then the father. This is the problem with our current judicial system. That judge should be removed from the bench and made to serve the rest of the prison sentence he handed down. The father, in my mind, not only had the right to correct the situation if it was as described, but also the responsibility. Keeping this kind of testimony out of court proceedings is wrong. The public should demand the judges removal. You should have the right to not only self defense but the defense of your family. The fathers actions did stop the abuse.

If I read your question right, and if it actually happened (if) this is what I think. (Proof read your question, you can use more then 2 periods in this and word it a little better.)

The child was the victim here. The father, who did what any father would want to do, is both. Taking in your own hands what would still be considered a criminal offense still makes you a criminal. I would want to shoot the stepfather myself but no matter the reason it is still murder. The father could have petitioned to a hire court, and could have made claims that there was important evidence ignored due to the step fathers status in the community. There could have been numerous ways to do this. Law does not protect eye for an eye. However it makes him the victim because justice was not served and now that he has done what he has done, justice will not be served. It could be possible that this was happening to more then just his daughter. It's a sick and twisted world we live in now, but we live in it and we have to somehow make it better.

Technically, if everything in this question is accurate, the child and the deputy were victims. The father and the deputy were criminals.

However...

I've never met a child molesting, fire startin', clepto Deputy before. If these allegations are true, in which court was the deputy convicted? If there was a conviction, there is no way he was still a cop.

Can you post links to news articles to this deputy? If the allegations are true, the media would have had a field day with the situation.

Not counting pedophiles as victims (we all know this history, right?), the child is the first victim, the father the second.
I wish dad had a better lawyer. Maybe Gloria Allred, she's a champion.

Theoretically they both are. Legally as well.

I'd have to see both sides to decide if justice were served. You've only presented one side.
