Gee, let's see.....ask your your lawyer, that's why you're paying him/her...to answer these things for you. But let's say you didn't have a lawyer....how can anyone possibly attempt to answer your question since 1) who knows what state you live in and 2) who knows if this is an injury claim, a damage claim, a product liability claim, a wrongful death claim?

No. However, you can't change lawyers now, but you sure can light a fire under their tail. Remember, the lawyer works for you, so therefore you actually control your case.
It could be the insurance co. has not even made an offer, so why settle? There are too many variables to really answer you.
