Hi,
I had rented a van from the rental agency in USA. I had taken full insurance for the van. I had park the van some where in parking lot, when i come back to lot i found that it's got damage on passenger side. I didn't made any complaint to police b'coz i don't know who had done that. But when i am returning the van i informed to the rental agency people about the incident, they told me that i am fine and no issue, b'coz i have full insurance. But now the rental agency calling me and told that i am not fully covered, and they are aksing for complaint. As i have't informed to any one. Plz help me to get out of this hell problem. I am really facing mental tension b'coz of this problem.

Do you have proof you have "full coverage"? And what exactly did your full coverage include? was their a deductible included?

Honestly.. i find it really hard to belivee that a big company would just lie to you and say you didnt have full coverage when you did... i dont think were hearing the full story here.

If you have a copy of your contract saying all accidents were covered for that vehicle.. that is proof enough. But maybe you were confused about your coverage? Maybe it didnt include damage to the rental or something?

We definately need more info.. its not time to get a lawyer yet.. thats kinda ridiculous and will likely cost more then the damage does..

Ok you need to do a couple of things.

1) Hope you hung on to your rental agreement because you need to read it to see EXACTLY what is meant by full coverage. In simple english...You got what you got. Whatever that contract says you have is it. Nothing more, no matter what you like, and nothing less despite what the rental company says.

2) Call YOUR auto insurance company and make a claim.. pronto. Generally whatever you have for your private car will carry over to rentals. If that is the case put your insurance company in touch with the rental agency and give them a copy of your contract.

3) Call the police department where the accident happened. Its a long shot but perhaps someone reported something. Only costs you the phone call to find out.

4) Go back to the rental agency with a tape recorder and see if you can find the one that told you everything was find. Ask her if she was mistaken or if the company is...?

5) If all that fails and the repair bill is on the same price level as the gasoline charges that a rental company levels, then you prob. need to go see counsel unless you are willing to foot the bill.

The babe from Florida is correct. Read the 'temporary substitute vehicle' clause in your policy. All coverages (including a deductible) extends to the rental vehicle in the event of a loss. So, pay the rental company your deductible and let your insurer deal with the rest of the problems. And, NO, it's not your fault. So -- what if you park your personal car in a parking lot, come back and it's been hit? Still not your fault but you have to pay the deductible under the terms of your collision coverage.

Hint for future reference:

For proof of damage on any insurance claim, whether it be your's or a rental, you ALWAYS need a police report.

Yeah, call an attorney. Without a police report, it will be hard for you to dispute.

I know how you feel. The only thing you can do is get a lawyer. It sucks but other than that you have to pay.
