i bought a new car and after 4 mo i met an accident and agreed for the repair beacause the engine was not damaged. but after 2 mo the mechanic said that they need to repalace the engine block because it is damaged. we didn't agree and demand for a total. but the insurance company said that in their policy they can add unforseen damaged on my car. please help, can i as legal help? is this fraud? because from the start they didn't tell us that the engine is damaged so that i cant claim for a total. thanks.

You have no right to 'demand' your vehicle be declared a total loss. What's the big deal? An engine block is just another component and can be replaced or repaired like anything else. The insurer is perfectly within their rights to opt to pay for repairs to your vehicle if the costs of those repairs are less than the value of the car or a set percentage of that value set by your state government. You may be able to collect the money for the damages and sell the car as-is if you like.

It is just like when you take your car in for repairs, the extent of the damage is not known until they get into it. In this case the insurance company will send a investigator to the shop to check on the amount of damage after the mechanic has looked into it. This happens many times in accidents.

Ask yourself how they could tell if the engine was damaged ?

Prob. not until repairs are underway.. but this is a pretty common instance in auto repairs. You never know what is really wrong until you find the problem.

But what is your complaint anyway.. they are paying to fix your car ...

Most people complain when the car is totaled out.. They end up getting less money then they even OWE on the car.

Seems like everyone is working to get your car fixed for you so why all the complaint if it is not your money?

When repairs exceed the value of car in an accident, only then will insurance total the car.
You will not be able to obtain a new car, in your case.
