I like Ruby Tuesday's idea on Double Jeopardy, however, aren't zombies technically classified as undead? If so, that begs the question that if you kill a zombie, are you really just finishing the job that other zombies started in the first place? If so, you might be considered an accessory to murder. Although, you might get off with the a good self defense strategy.

Therefore, destroying a Zombie cannot be murder since they are already dead.

Double jeopardy.
You can't kill someone twice. And if someone doesn't have a heartbeat and no more brainwaves, I'd say that person is definitely clinically dead.
