I work for a retail store and for some reason they have not given anyone a paycheck for at least the past month. If i refuse to work until i get one, can they fire me?

Keep in mind, i am going to refuse to work if they can fire me or not, i am just wondering if they can.

You can report them to the labor board, because by law you have to receive a check at least every 2 weeks, if you are not exempt, which if you work at a retail store I doubt that you are. I would say you probably are working for free as it is so it would not really mattered if they fire you, cause you are not getting paid anyway. Why do them the favor of working for free.

if they have not made payroll for a month,it would seem they are going broke.leave and file a claim with your states workforce commission for un-paid wages.if it is a "chain" store,could be something as simple as an incorrect mailing address,but it still sounds very strange to me.also,if the store close without paying you,you will have a difficult time receiving un-paid wages unless you file a claim as stated above.

You can be fired for refusing to work (insubordination); however, you can then turn right around and sue your employer for not paying you.

Employees are legally entitled to receive pay for hours worked within the pay period specified by the company. Companies must post their scheduled pay dates in the workplace, and must pay according to that schedule. If they do not, you have a case for the labor board (www.dol.gov)

depends on what are your pay days?? also if ya get paid once a month they might hold a check also depends on also if you started in the middle of a pay period might take a month or so Have you ask why?? also labor law in your State and call them asking report them But yes you can get fired its insubordination

This usually depends on where you live, but in most states, yes. You can take legal action, but you need to keep up your end of the bargain when you agreed to work there and provide your services.

contact the better business bureau and they will advocate for you. I had a similar problem with a company i worked for not providing benefits that were in my contract. Look them up they will help you if you provide legitimate evidence.

But remember your fighting a corporation with lots of money. Be sure you want to take a portion of your life and dedicate it to this.

If you are not getting paid when you should have been paid, I'm sure that there is a government agency that could help. Could be the state department of Labor. Where are you located?

Sorry you are in that situation. I dont know what state you live in but in Utah we are *A right to work state*. That means they can fire you because they dont like how you combed your hair. It just cant be a federal violation.

I can legally fire somebody if they walk into my office in a pink shirt. She/he might say why am I fired? I said I dont like pink. Is it wrong? Is it discrimination? Absolutely, but its not illegal, not in Utah.
