I am a native indian born in Vancouver, B.C. now living in Oregon and in July I plan to drive up to Vanc. will I need to get a passport yet??, My dad was a native born in Nebraska and lived in Vanc., Does this give me dual citizenship under the " Jay Treaty " ?? Thank you all for your time !!

No you will not need a passport and no the rules for driving have not changed. All you need is your drivers license to go back and forth.

The rule what was changed had to do with flying or going by boat to Canada and Mexico. Since you are driving it doesn't effect you. However you should apply for a passport anyway, as the USA will be changing this rule sooner than later.

I don't think you have any rights under the "Jay Treaty" unless the native Indian blood you are claiming is also an American Indian tribe. If that is the case, then you do. Either way you should be able to claim US citizenship through your father. Contact the US State Department and they will let you know the rules and proof needed.

You do not need a passport for a land crossing. The date for those changes all the time, and you need to check back. Right now you can get into Canada with a birth certificate and a drivers license, or a Status Indian Card.

You do not just get dual citizenship under the Jay Treaty. If a Canadian Citizen, you can apply for Citizenship under the Jay Treaty when entering the US. But it sounds like you may have a case. However, if you do that, you are best to have all your paper work in order. AND it means MORE information providing for that entry, not less information. Once processed it means you can apply for a US passport. I believe their is no Jay Treaty process for the other way around - a US citizen entering Canada.

I think it changed the beginning of the year. You will have no problem going to Canada, but crossing the border back to the US you will need a passport. So yes you will need a passport.
