we recently started moving out. we had to be out by the 30th which is tomorrow. well the landlord has called my mother who lives with us several times on her job. we went over last night to get the last of our stuff. everyone works and only one car, come to find out my landlord has had people in the apartment they have painted it and ruined some of our things and stolen stuff. my question is this.. is she legally allowed to go into that apartment before we turn in the keys. hen we got there last night she had people in there cleaning. someone stole 2 antique plates that were worth a grand or more each.she claimed we owed her money so we think she stole them. also do we have a criminal case against her

The landlord is in the wrong for entering the apartment before you have completely vacated it. The only repairs that can be done without notice are those that are emergency in nature and require immediate attention in order to property damage, for example a burst water pipe.

First step would be to call the police to report the theft of the plates. For the damaged items you need to document what has happened and file in small claims court for damages. If you owe the landlord money make arrangements to pay and maybe things will work out.

Call the Police, and make a report for theft. The landlord isn't allowed to enter, unless there is an emergency. As far as any money owed, that is strictly a civil matter, and she can not withhold any property.

She can go into your apartment for repairs whether you are there or not. As to your personal belongings, (in Florida) if you owe her money she can sell them and deduct the amount paid for the items from your bill but generally speaking this requires a court order . . . Painting and cleaning are considered repairs.

if the rent was paid up, the apt is yours till the end of the lease and the landlord had no right to enter. make sure you document everything, photographs, try to recronstruct all your conversations, don't lose any notes that you wrote or received etc. call the cops and judge judy :)

In CA, only with posting a 24hr notice of intent to come in.
