I was selling my 1990 Eagle Talon for $800.... on the ad, I listed everything that was wrong with it...I stated that it needed a few things before it would pass inspection. The person who came to buy it SAID they were 22 years old. He looked at the car, and decided to buy it from me for $800 cash... So I signed the title over to him, took the cash, and he drove it away,... also my car was a 5-speed, and when he bought it he said he didn't know how to drive a standard and not to laugh at him...I said it was his car now and I didn't care...He attached illegal plates to the car... and drove off in it...then last night, HIS MOTHER calls me and calls me the C word and tells me I sold a car to a minor and that she was returning the car to me. THIS KID LIED TO ME!!! What are my rights? He knew it wasn't going to pass inspection and that he needed to fix it and he agreed to fix whatever was wrong with it.... now this woman is threatening my life and wants her money back?? Help! I

Also I don't have the money to give back to her because I sold my car to pay bills and that's exactly what I did with it....Does anyone know my rights as far as being in Massachusetts?

I don't care about the threatening part... I just want to know what my rights as a seller who A: has been lied to...this kid committed fraud... and B: Listed everything that was wrong with the car and the kid took the car As is.... what are my rights?

To Joes mom: the car needed one thing to get an inspection...I think you need to not jump to conclusions... and also what do you expect for a car that old?? people sell old carsl ike this all of the time for WAY MORE MONEY...SO PLEASE DON'T JUDGE ME... I MYSELF AM ONLY 22 YEARS OLD...WHAT KIND OF MOTHER IS THIS WOMAN TO NOT WATCH HER SON MORE CAREFULLY? SHE SHOULD HAVE COME WITH HIM, BUTI NSTEAD HE LIED ABOUT HIS AGE..I DIDN'T TAKE ADVANTAGE OF HIM...he took advantage of me....

Tell the mother to go to hell. You are not a car dealer, her son misrepresented himself and paid you cash for your car. That's a legal business transaction. It's not your responsibility to check his ID and it isn't illegal for a minor to buy a car for cash. Call the police if she contacts you again. She should spend more time worrying about her deceitful, idiot son than harassing you.

I think you may be ok here. If he bought the car, paid you money, and you signed over the title, he owns the car. A bill of sale would have been nice, but I think you're ok on this on a legal basis. It probably wasn't right of you to say that it was his car now and you didn't care. Even though you are right - it's really not very nice.

There is one thing that may cause you a problem. If he truly in a minor (under 18), he is not authorized to sign a binding contract without a legal guardian. This means that his mother would have to approve. How old was he really?

Regarding the mother, I would keep a log of her harassment. Try to record some phone calls. If push comes to shove, you can use this to prove distress on your part.

I would get legal assistance ,some times you can get 1 free consultation from any attorney. but personally you should have gotten there drivers license and made up a receipt with the buyer and put all info down on paper .I think you would not make the same mistake again.

why would you sell a piece of junk like that anyway? knowing it was in need of repairs that bad? you could have scraped it out and got more than $ 800 for it. it was 17 years old. what goes around comes around...
