NASCAR owns the numbers. They lease them to the teams. Every season the teams put in a request for certain numbers. If they had the number the previous season then they get first consideration on the number. If they do not request the number then it is up to NASCAR who gets the number if another team requests it.

There's no point joining the "NASCAR owns 'em" chorus, but someone should point out that the teams do own the design (font, style, exact color combination) of their numbers as they appear on the cars. This is important in marketing and the very profitable merchandise sales.

For example, you can legally print big white "8"s on red t-shirts and sell them anywhere, because nobody holds the copyright on the number 8 or even on the general red/white combination. But if your "8" looks like Jr.'s in font, style, type of outline, etc., you'll be hearing from DEI's lawyers.

NASCAR owns the numbers, and the owners "lease" them on a requested/assigned set-up. The team owners can't sell them and can only trade numbers with the approval of NASCAR.

NASCAR owns and assigns car numbers to an owner(s). NASCAR reserves the right to revoke or transfer car numbers to another owner/team at any time. Car numbers are non-assignable and non-transferable, except by NASCAR.
And just updated: Car owners are allowed to lease each number for one year, NASCAR spokesman Ramsey Poston said. Teresa Earnhardt, who currently controls her stepson's #8, can renew that lease next year to keep him from using it.
