I was wondering... I was holding a beer can in a photo that was posted online. This picture is now causing lots of problems with the VP at my school and the campus police. Is it possible for them to give me an underage? yet alone any type of alcohol offense? they don't have proof i was drinking it.

Our VP is all about the "no drinking on campus"... and now he is aware of "facebook" where students post photos, chat with friends, etc.... he has a few accounts where he goes on and finds ppl underage drinking.. he's trying to get people busted. he came across a photo i was in where i was holding a can.. im an education major so im worried i'll get in trouble and have to switch majors

Yes.

School officials act "in loco parentis". Hmm. That sounds like they act like crazy parents, but it actually means they stand in place of parents.

Parents don't need proof. They're allowed to react to situations based on the evidence they have.

And if I walked in my kid, and he had an open can of beer in his hand, I would not assume that he was holding it for Frank, who left 20 minutes earlier. Your hand will warm up the beer. If you're not holding it to drink it, you put it down on a table.

Is that unfair? Yes. Is that a potential injustice? Yes. Is that going to happen anyway? Yes. Because the point is they are supposed to keep you out of trouble, and the easiest way to keep kids out of trouble is to keep them FAR away from trouble.

Your parents can complain to the VP that they believe you when you insist that you weren't drinking. The VP will point out that you had possession.

My advice is to throw yourself on the mercy of the VP. He probably doesn't have any, but you can try....

Thats exactly right. You could have been holding the beer for someone else. The only thing they can get you with is possession, and thats ONLY if they were there, in the photo, at the time. If they give you any trouble, dont buy it. There is nothing for them to charge you with, for all they know it was a beer can full of water. If they try throwing some kind of threat your way id suggest talking to a lawyer if you can. They can make sure you stay out of trouble and make the VP feel like an ***.

I would imagine that they could only have a problem with whomever posted the photo online. It really doesn't have anything to do with you, other than you being in a picture. They can't punish you for holding a beer in a picture. The cops definitely can't do anything, and your school can only punish the person that posted the pic. I'm pretty sure you won't have any problems.

It is very possible. but over-all i'm not sure. why were they so interested in it in the first place?
