I doubt it, but honestly, having lived in Guatemala if you are planning to stay there no one is going to know. Any alcalde at a poor municipalidad will probably marry you without question. However, should you return to the US, it will not be a legal marriage.

If you are an U.S. citizen you are welcomed back into the good old USA ... But if you became a citizen while living in Guatemala then you're stuck with it ... I don't think it has do with marriage

File an annument of your first marriage so that you could marry again. Otherwise, bigamy can be charged against your for marrying another while a former marriage is still existing.

I suggest you go to a library there in Guatamala and research Guatamalan family law.

you need to get in touch with the Philippines gov. for divorce procedures to get divorced , read the laws about legal separation , but as far as the law is concerned ? you cannot get married if you are already married .
on your passport ? it will show your married name? will it match your birth name certificate ?

you should ask this question to an inmigration lawyer, to me seems like you can do it, cause this person has dissapear, and he probabbly divorce you already, but still you don't know what he is going to be up to, so like I say, try to find out if this man is dead or alive, and which can be your next move.
