His greencard is about to expire. They gave it to him for a length of 10 years which will expire in 2008. It was based on marriage but, how do I know what form to fill out? How do I know if his greencard is conditional or not? What form should we fill out I-90 or I-751? Would like your advice. Also how long does this process take to get the new greencard back?

Since he received a green card with a 10 year expiration date, he will need to fill out a Form I-90 to renew the card itself
The I-751 is for a Petition to Remove the Conditions on Residence for a "Conditional Resident" which usually applies to residency that was given for a 2-4 year period.
He should apply 6 months before it is due to expire especially because of the backlog that is at USCIS

Hello:
You need the following forms:
1. I751 Petition to Remove the Conditions of Residence
2. G325 Biographic Information (Two Copies)
3. Tax Returns for the Last Three Years
4. Letters which are notarized from Friends or Family Members who can verify under penelties of perjury that you two are living together and there are no resons that you should not live together for ever. These letters must be from a Citizen of United States and this person must know both of you for at least 5 years.

Better option for him will be to apply for Citizenship.

your husband is here legally and his greencard can be renewed easily. call your local immigration office to see what forms you need. it probably can take a few months for a new green card since he has to do another fingerprints or interviews. perhaps, before his green card will expire, he should apply for citizenship. that way you dont have to pay more again if he decides to do that after renewing his card.

Go to your local INS - it's most likely the I-90. It takes about 3-6 months to get a new card. The best thing is to go to the local INS office and talk to the officers there. OR talk to an immigration lawyer.

Why don't you apply for his citizenship? He is eligible to be one now. See, the government is saying that if you haven't applied for citizenship while you can, why should they renew greencards??

You should contact the USCIS ....... they should be able to tell you what to do. (Since you have not recieved any letters in the mail for renewing the Green Card)

the status of the green card NEVER expires. green card is permanent residency. however the card may have an expiration date and can easily be renewed.
why didn't he apply for citizenship? after 5 years of receiving his green card he can apply for citizenship.
