Ok, some real facts here to help you compare:
First, ( and I know it sounds trivia, but it's not), look at the differences in the looks of the cars. They are different and one is uglier than the other. If you can't live with the ugliness of one, don't pick the Touareg. (ok, now that THAT's out of the way...)
The Volvo XC90 is a sedan-based vehicle with smoother road handling and less noise than the Touareg. It also maneuvers around parking garages, parking spots, etc, with more ease.
The Touareg is MUCH heavier, even though it is MUCH smaller and will carry MUCH less (people or cargo). It is a significant amount less fuel efficient than the XC90.
The off-roading capabilities noted above are better proven by a true test. Each year these SUVs actually compete for off-roading titles at an event called the MudFest. The XC90 won even over the Hummer in being able to handle more different terrain.
VW's (and all German makes) seats are more sport-oriented and harder. Volvo's seats have been named Consumer's Most Comfortable (short and long trips) ...for the past 13 years...
Safety is not bad with any vehicle these days, but the Volvo is still 15 years ahead of everyone. The Volvo XC90 is the only vehicle that has a true anti-roll mechanism integrated into it's AWD system. It also has boron-steel (4 times stronger than regular vehicle steel) roof pillars so, in the unlikely event of a rollover, the car doesn't even change shape.
The Touareg has better-looking wood accents and was considerably faster with the V8...until the XC90 V8 came out.
DRIVE them both! The differences in these two cars is night and day. Where the Volvo seems to have some smoothness and finesse, the Touareg has very abrupt acceleration and decelleration. It feels very heavy when driving it and seems to almost lumber around as one solid, unyielding piece.
The dash read out in the Touareg is more attractive, due to it's use of red and purple lights. The Volvo uses green, which doesn't look as cool.
The Volvo has a sideways-mounted engine, making the hood shorter and maximizing interior space. The Touareg has a longitudinal-mounted engine, which maximizes the hood and greatly reduces the interior space.
When I shopped the Touareg, here is one of the main things I noticed, and you should see if it bothers you, too. Get in it and put the key in. It's obnoxious. There are buzzes and warnings and tones and blips and irritating sounds you can't even decipher what they are for. It drove me crazy every time we switched drivers!
The two are a good comparison in that they are in the same class, but the differences are glaring. Liked the idea of both, drove both, love my Volvo!

The Volvo should be better, but it had some issues. The 2007 and 2008 Volvo XC90s are much better vehicles than their predecessors in terms of reliability. Touaregs and Volkswagens in general are improving. But I would not even consider a 2004 Touareg. If you get one, you need to set aside a lot of time and money for electrical issues. It may be as troublesome as the older MB ML's. I recommend the Volvo.

Volvo has had problems with the 4x4 abilities of the XC90, it is not a real 4x4 so if you have any need for the 4x4 capabilities I would prefer the VW. In europe the VW scored extremely hign on the SUV scales. Depending upon options mainly the 4x4 package it is up there with the Land Rover Defender the the Mercedes G type. Which our the best civilian 4x4 on the market.
One consideration that I would have is who has the better dealership in your area, VW or Volvo, you will need parts and repairs add this into your consideration.
Had I the money I would get the Touareg, much better all around. Another problem Volvo has with the XC90 is the 3.2liter engine is a bit underpowered for the weight of the vehicle. In 2007 they introduced the 4.0liter V8 to make up for this problem. While the VW V6 has plenty of power for the weight of the vehicle.

the tornrag is nothing but a stripped pooch Cayenne neither vw product has any off road capability and with the wide tires are pretty marginal in snow [yes they will move off but with all that tire surface they tend to slide at speed and stop poorly once the tires start to wear]***[on recently scraped and salted roads]***
the volvo is a more stable snow car and can attempt light to medium Jeep trails with drivers of good judgment.
parts for both are expensive however the volvo is a little easier to service and maintain
note if you really want a luxury 4 wheel drive truck the standard is the Japanese grand wagoneer TOYOTA LAND CRUISER NOTHING ELSE COMES CLOSE TO THE LUXURY AND REFINEMENT AND RELIABILITY, PLUS IT WILL TAKE YOU TO AND BACK JUST ABOUT ANYWHERE. even as much as i love volvo's the truth is the truth

upon personal preference I will take the Touareg all day long.
Both are great and have their pros and cons. Both are very safe. I cant help it, I am a VW fan and I like the styling and features of the Touareg better.
