Because of my father, who is now in jail, my house was raided. They took anything illegal as well as his dmv papers (pink slip, registration) We now need to sell the car because it is a manual and no one in my house knows how to drive one.fyi his car had nothing to do with the charges against him. So does anyone know how i would go about getting the dmv records back? or can i get it back?

Everything in the legal realm is operated through documentation. Contact the judge's office that issued the search warrant. If the place was raided, there had to be a search warrant issued from a District Court. Ask the judges office if you can obtain the records. If the vehicle is in his name however, there may be some difficulty.

The only way the car would have been impounded is because it was used in the commission of the crime. You didn't say what your father was arrested for so that would have explained the situation a bit more.

The vehicle is in your father's name so you couldn't sell it without his permission anyway (power of attorney or notarized statement giving you permission). You can try to get papers from DMV but until it is released by the detective in charge of the investigation, you can't do anything.

Step 1 ~ Contact the detective and find out if there is any chance of getting the vehicle released to you. If your dad used the vehicle to sell or buy drugs, during a robbery, etc, you might have to kiss it goodbye because many cars have been confiscated (per court order) and later sold by the PD once they have won the court case.

Step 2 ~ IF you get a release from the detective, then you have to get something from your father that gives you the right to sell the vehicle.

Step 3 ~ Then you can go to DMV/Title Dept with all your paperwork to get a new title (unless the police have it and release it with the vehicle).

Be sure and keep all original paperwork for your files. If anyone needs copies, let them copy what they need.

One exception to that is the release from your father. You may want to have two papers notarized because they will most likely have to keep one of the originals with the documents at DMV.

Your father's lawyer should be able to help you. The records must have some relation to the case against your father or the police would not have been able to seize that information. There also may be some obstacles to your selling the car if the case is still pending (even in appeal).

Police can only take things out of the house that were listed in the warrant..so there must be some reason they needed those papers (did he use the car in the commission of a felony etc...) call the detective and ask him..but I think you should be able to contact DMV and request copies...good luck

The best thing you can do is start by requesting they return what you need. If they don't, then you will have to sue for it. Should the items in question have some value as evidence against your father, then don't count on getting them back for a long while.

if they took the papers then the means that it is probably means that it is evidence and they need the car or papers in court. but if you really need them then try foing to the office and talking with the officer and see what they can do.

Depends.... if they took it, then it must in some way be evidence.

Call the case Detective. Explain to them your situation. They will let you know if you can have it back or not.
