Two kids, real dirt balls, who don't care if they get into trouble or not, continually threaten a beat down on my two other brothers, and potentially anyone else hanging out with us. I'm not a top target, but if I'm with my brothers and they attack, they will undoubtedly target me too. However, without engaging in a full out battle against, most probably just these two kids, what other options or alternatives can we take. I know calling the police is the best thing, but the fight would be over in a few minutes, with someone probably severely hurt, maybe even dead. Cause they are dirty, they might pull a gun and/or knife, etc. How can we defend ourselves? Let's say they come up to us and start shouting stuff like "Come on, let's do this!" And then one starts pushing and swinging, are we allowed to attack in defense? Also, when the cops come and break the tussle apart, who would be charged criminally? What charges would be charged? Any other routes to take?

All Americans have the right to self defense. It would be nice to document harassment in some manner to use in your defence if something were to happen.

Remember that if you do defend yourself you cannot "finish someone off" you can only use sufficient force to stop an attacker. I.e. you could punch someone who attempted to punch you but if you were to knock them out you could not put in a few parting shots.

If they were to use lethal force, like the knife you mentioned, you could use lethal force to defend yourself or your brother. I would recommend that you do not get into a streetfight but if you do try to have witnesses that you attempted to leave without fighting.

Each state's laws vary depending on the situation when it comes to self defense. If you are in the confines of your own home you have the right to do what you have to do to protect yourself. If your in a public place, some state laws basically say that as long as you have an avenue of retreat, you are as guilty as the person who started the altercation. All parties involved in the altercation could face charges ranging from Disorderly Conduct to Battery charges. It just depends on the situation. Your best bet is to contact your local police or sheriff's department to obtain assistance in filing harassment or similar charges (depending on the state), In some jurisdictions when a person is found guilty of harassment or a similar charge, they are put under a "no contact" order by the judge as part of the sentence. If they violate that order it could mean jail time. Hope that helps.

How about calling the cops right now. Get a paper trail going that shows that these clowns are the primary aggressors. When something does happen, you'll have a record showing that they have been harassing you.

First off you should have a restraining order against them. Next if they throw the first punch it's on them but you can't provoke them.

You have a right to defend yourself. If I was attacked I'd use everything & anything to disable them even if it meant their death.
