Through the legal process. There needs to be laws defining what is allowed and what is not (incest, under age, etc.)
However, preventing gay marriage between consenting adults, as far as I can see, is unconstitutional as it is discrimination.
I can only assume that this has not been challenged yet because they are waiting for a supreme court that rules from the constitution rather than from their personal beliefs.
If a church does not want to perform or recognize it fine, that is the right of that church. But the state should not be able to prevent it and the rights and benefits that go with the legal state of marriage.

Because there are tax consequences related to it. If we remove all income tax and move to the FairTax then there would be no tax benefit to being married and the government wouldn't be so worried about losing potential tax revenues from married gays.
The typical argument, that it will erode the sanctity of marriage, is a bunch of BS nowadays. Straight people, especially in Hollywood, have made a mockery of the institution. I don't think gays that love each other can possibly do more damage to the institution than all of these 'publicity' marriages that we see from celebrities.

The same way that it is able to legislate no praying in schools.
Yes we are all given free will. We can either choose God or choose to live our lives however we want. In the end the only way to heaven is through God.

Sorry, umm. I don't consider "Follow me or burn in hell" a good free-will choice. Don't tell me that's not what he said. It's what a lot of you people try to convert me with.
And they can't. It's a freedom, that cannot be taken away. The fundies just won't allow it in church. The homosexuals obviously aren't thinking of a marriage at City Hall. :D

In effect you say, "Answer my question, but don't use the Bible as a source." My, how cute - denying ME free will! Assuming your question pertains to same sex marriages, I'll not use the Bible, I'll simply tell you that being married requires two different sexes. You want to call your gregariousness a civil union - go for it, but don't expect me and several million others to ever accept your silliness if you want to call it marriage.

Religion is about control. Government is about control. Both have been fighting since the dawn of humanity over who runs what.
Religions only give lip service to free will - the equivalent of me holding a gun to your head and saying, "You can obey me, or I can blow your brains out - your choice."
If religion REALLY believed in free will, you would go to heaven whether you believed or not.
