1) citation was written as charges being listed: disobeying traffic control device** No signs, signals, or anything was there! Just a bridge / water on two lane highway.
2) Nature of offense: clocked with robotic device at 49 in posted 35 ** What is a robotic device? ALSO no road, direction of travel is completed, and in both sections, charges and offense block, the "other" box was check marked... not speeding...final question: This is the second patrol stop in 2 days, and I just got my car back from the garage, as it was in a reported/insured accident, hit drivers side, (Boss hit my car with the dumptruck at work!) After receiving tonights citation, drove through an electronic speed trap, which stated on their sign that I was going almost 10 mph more than what my speedo was reading. If I have proof the car was hit, to be fixed by garage, but wasn't, will they drop the summons? Do I take this proof to police or ask for a magistrate hearing? Thanks for any help.

There are always problems with these robotic devices. Sounds like you were charged improperly with the first one if you didn't run a stop sign or disobey a light or yield signal. Its up to the police to prove that you did this and it doesn't sound like they have the evidence. The other situation sounds very understandable,, I would go to the police station that is responsible for your charges and show them the proof. most of the time the police will drop or (Nolle Prosse) a case that they made an error on, but you have to be careful and make sure they do the necessary paperwork or else the court will find you guilty if you don't show up to court. Worst case you will have to go to court and just show all of the proof to the judge who will then drop it. Just make sure that you take your time and explain everything without losing your cool and make sure you have every detailed piece of documentation with you. Most people lose in court because they are not prepared and they didn't do the research,, there are a lot of people that could get out of traffic violations if they only knew the law. Good luck.

Read the whole ticket again carefully, and see if there is any mention of speed. A traffic control device, could be a speed limit sign, but it is not usually referred to in that way. How many violations did your son commit?. Maybe he got a ticket for one violation, and not the other. THEN AGAIN, maybe the Officer made a mistake. Too many unknown factors, sorry!.

Traffic control device could be referring to a stop sign, speed limit sign, yield sign, etc.

Where you were taking your car will not impact into the decision on whether the ticket stands. You will have to challenge that the method of speed detection was wrong. If you want to challenge the ticket, you will have to do this in court.

That was the officer's way of being nice to you. Take it heart next time you think we are jerks or pigs. Instead of writting you a ticket for speeding, you didn't obey the speed limit sign,so that is why he wrote that. A robotic device is a photo radar van or a camera at an intersection.

If you speedometer is wrong, that is NOT a defense. However, if you can prove your speedometer was wrong and that you had it repaired before your court date, many judges will reduce your fine.

Find a good "Traffic Law Attorney" and explain your mess to him/her.
