Will the poor people who have suffered Flood Damage have a problem with the Insurance Companies.
I ask this question because a Friend of mine had Gazebo
wrecked in recent storm.
Insurance Company refused payment on the grounds (ACT OF GOD)

Homeowners' insurance does not cover damage caused by flood.
To get coverage you have to buy a flood policy from National Flood Insurance Program. But that coverage is limited to the dwelling and contents in the dwelling, on the first floor and above.
There would be no coverage for a gazebo.

In the UK Flood is a standard 'peril' and unless the policy specifically excludes flood damage then damage to the buildings and contents will be covered.

BUT the policy may exclude damage to articles in the Garden due to flood or storm and this is probably why the Gazebo was not covered - I have never in 25 years ever heard an insurance company claim 'Act Of God' as a reason to not pay out on an insurance policy.

The only reason why flood damage may not be paid is if the owner was aware that the property was liable to be flooded and had not told the insurance company (non-disclosure of material facts).

Well, flood isn't covered under a Homeowners policy. The insurance company didn't deny because it was an act of God, that's NOT the real reason - he made it up. I've never, ever, EVER seen an insurance company use that phrase.

But FLOOD is EXCLUDED on ALL HOMEOWNERS POLICIES. You can ONLY buy it through the federal government FEMA program. THEY set the rates & rules.

So clearly, he didn't have FLOOD coverage.

If you have FLOOD coverage, then it's covered. If you have WIND coverage, and the gazebo is NOT a permanent structure, well, it isn't covered for weather damage on a homeowners policy.

Your friend needs to talk to an AGENT to be sure he has the coverages he WANTS, BEFORE the loss happens.

Acts of God is not an exclusion. If they are talking about Flood then that is excluded. "IN ALL HOMEOWNERS POLICIES"

As mentioned by others ..ask your agent about the National flood program. Several conventional insurance companies have special depts within to write a policy under the program.

Heads up! There is a difference if the Gazebo was damaged by "WIND" or Flood. If wind it would be covered as an outbuilding.

for this case, flood may be excluded from the coverage. Kindly check the policy exclusion clauses to confirm this.
If this is true than the insurer can refuse payment. if not your friend can contest the claim.

Insurance companies have the policy , If we can avoid payment then we don't

Fed up to back teeth with insurance they seem to have a get out clause for everything these days I don`t know why we pay them it`s another rip off.
