insurance company now to let them know my car was in an accident or wait till I speak to my lawyer? (I was in the hospital for 4 hours getting xrays)ouch

I am not in jail, someone failed to yeild the right of way to me, now my car is totalled, there is no fixing it. the blue book is only about 2600.00 which means I must sue otherwise I will not get enough money to buy a new car. I had a lot of money into the car, brand new tires. 1000.00 worth of rims... I could go on for ever this was my baby and she's dead. :(

la428282, ok, if I could write you a personal email I would let you know how totally ignorant you are. I have only used a lawyer once in my life cause the last @ss that hit me I was a nice guy and didn't even do a police report, he claimed that he would pay me the damage, and guess what, I couldn't contact him for 3 months. I am sick and tired of being taken advantage of and people like you are part of the problem. reality is you cannot replace a car that you have put thousands into for blue book value, you have no idea what pride in your car is.I have terrible neck and back pain my car is totalled and you stand up for the one at fault. I hope one day your child has a similar situation and gets screwed just like you imply that I should allow. I WILL NOT ALLOW SOMEONE TO TAKE ADVANTAGE OF ME ANY MORE I AM NOT A DOOR MATT!!! if the insurance company makes a reasonable offer that is fine. but I can 99% guarntee they won't. I ask for help not a lecture from a knowit all.causeudont!

by the way all that claim I just cry, I want my lawyer. I have a friend that deals with these claims. and even though the insurance companies like to make you think you are getting everything that is due to you. one often doesn't. He is there if i need him and last time I had a problem with an insurance company not wanting to pay out, he got them to. their insurance company couldn't even get in contact with their client. there are some bad people out there, and dealing with a small insurance company I have never heard of scares me. if it were a large insurance company I wouldn't be as worried. I am a very nice girl who has been taken advantgage of many times. I never get the long end of the stick. Im sorry that people feel they need so stereotype me in a bad way. by the way this is the next morning my jaw is killing me, my head hurts like hell, and I feel all twisted up. am alive, but are any of these pains going to impact me for the rest of my life? may need to go toadr

Absolute first thing you should do is inform your insurance company let them and their lawyers take care of it. Hope you are OK

Call your insurance company and file a claim. If there are no injuries I do not think that a lawyer is necessary. Most lawyers only like to deal with bodily injury claims. They will charge extra for property damage claims. Anyway, have an adjuster look at your car. If the total cost to fix your car is more than what it is worth, they will declare it a total loss and give you fair market value for the vehicle. If the damages do not exceed the value of the vehicle they will pay the damages less your deductible. If no further medical treatment is needed, the insurance company should pay for your x-rays. If you are not at fault, call the insurance company of the person who hit you and file a claim through them. Once fault is determined they will pay to have your vehicle fixed.

Um... you dont think your lawyer will increase the value of your car right? Lawyers wont touch property damage. Actual cash value is what it is.. your not owed a new car.. your owed the money to get an equivalent car. again.. a laywer wont touch this.

I cant believe your rationale is "my car is worth this much.. so i must sue to get a new car".. no... you will get what your car is worth.. you cant just sue for more then its worth.... thats all your legally owed.

I dont see any reason to run to a lawyer in the first place.. any intelligent person can get just as much money and not give 1/3 of it away.

Atleast call your own insurance and let them know.. they are on your side...

Sure, if down the road you dont feel comfortable.. they arent paying your medical bills or something.. consider a lawyer... but are you in this to get rich? or are you just a good person looking for bills to get paid? Why get a lawyer when no one has done anything wrong?

Im not even going to preach anymore b/c you seem like the kind of person who runs to a lawyer and thinks they are the best thing in the world.. but the years of battling for a settlement you have coming will change your mind.. you will see and it will be too late. Lawyers cause so much unneccesary time and trouble its ridiculous.

People like you are why our legal system is screwed up. Your first call should be to your insurance company. If, as you say, the other guy is at fault his insurance will pay damages to your car and your medical bills.
You do not need an attorney unless the insurance company refuses to pay...in fact no lawyer can do anything until the insurance company finishes its investigation and tells you what it will pay. I'm sorry you were hurt, but screaming "I want my lawyer" will make things worse, not better.

Are you being sued by someone? Are you sitting in a jail cell somewhere? If not, why do you need an attorney? If you are not at fault, just get a copy of the police report and give it to your insurance agent so they can get your money to get your car fixed.

You don't need an attorney yet. Yes, call your insurance company and the people's insurance company who was at fault. It is their insurance company's responsibility to repair your car and pay for any damages medical or otherwise. Your insurance agent and claims agent should work for you. Let your insurance use their attorneys if necessary.
