i was the one who provided them with everything the other parties info and even the police report and they said there is nothing they can do because the other parties are not responding because they dont want to pay for the damages also the other parties didnt have insurance or a driving liscense.

Um.. what exactly do you want them to do?

If you mean that this is your insurance... and you dont want to have coverage on your own policy for repairs and the other party doesnt have insurance... do you want them to magically make the other party insured? What the heck do you want them to do?

if they cant pay out for you because you dont have the coveragee.. they cant collect money back... they cant sue for you.

Do you want them to shackle the person up.. throw them in the back of their insurance truck and torture them until they hand the cash?

You need to be more clear if i didnt answer your question bc this is very vague

and seriously.. these people who are saying to get a lawyer are crazy. Do you want to spend money?! The other guy DOESNT HAVE INSURANCE... you think a laywer is going to take a case where they cant get any money?! of course they arent! all they care about is money. People on here crack me up "SUE SUE SUE!"- they have no idea what they are talking about.

This is the problem with uninsured motorist. If you have full coverage insurance, file a claim with your company. The other party isn't going to respond. Then go to your courthouse and pay $77 to file a small claim against them for the damages. Include everything on the claim, the amount of damage, time off and anything else. The court will make them pay.

You can try to get a lawyer, but chances are they won't get much. If someone cant even afford to get insurance on their cars or licensed then what do you think they could possibly have that a lawyer could go after. I hate to say this, but you need to take this as a lesson learned. ALWAYS have the following on your auto insurance policies:

A.) Fully cover your own car!! With a deductible you can reasonably come up with quickly. This way at least your car gets fixed.

B.) Uninsured motorist. This takes care of your deductible in case you are hit by an uninsured driver (Like you were)

C.) Rental car coverage. This way you can continue to get to work until your car is fixed.

Now..back to the lawyer. If you have your car fully covered, you can get a lawyer to sue your own insurance. This is very common. They will cover all medical (Up to your binder amount, ex: $15,000, $30,000 per personal injury) But, you have to remember if you only have the basic coverage (Comp & collision) then that does nothing to cover yourself or your car. It is only for the other driver YOU HIT. Unfortunately, most people have to first get into an accident, suffer a loss or possible personal injury before they realize they have inferrior insurance coverage. You have to cover your own ASSets.. no one else will.

I do not think there is much you can do if they do not have insurance. You can maybe sue the driver but if he/she does not have insurance or a driver's license, chances are, you are not going to get much from them.

If you have insurance, as you say you do, you can claim this accident on your own insurance. You will be stuck with the deductible, but it's better than having a damaged vehicle.

There are plenty of lawyers out there that are waiting for this exact scenario. They will take your case without money down, and sue the insurance for maximum plan coverage (usually $25000). You should definitely open the phone book and start looking for accident attorney's. Good luck!

Your insurance should cover your repair costs,dependant on your type of coverage,and in turn sue the other driver for the total amount.
I was on the losing side of this same scenario.
Her insurance co. sued me for $1800.

definitely get a lawyer. If you have insurance though I would also suggest to have uninsured motorist coverage also. This covers the situation you are talking about if they dont have it. But definitely sue the person.
