Recently, my girlfriend, my brother, and I were out driving. I was driving her car when we were pulled over by two deputies for my failure to use a turn signal. Well my girlfriend gets all jittery and starts moving around which must have raised the deputies suspicions. They gets us all out of the car and while one is watching us the other searches the car. The car is clean with one exception. Under the seat where my girlfriend was sitting is a bag of marijuana. It is beside the point that I knew nothing of this. In any case, we were all three arrested. Here is the core of my question. My brother and I were handcuffed behind the back and my girlfriend under whose seat the weed was found and in whose car it was found was not. The deputies didnt have a third set of cuffs so she was allowed to sit in the back of one of their cars with no cuffs while my brother and I were cuffed behind the back. I thought if you were arrested you got cuffed. And why was she not cuffed when we were?

No, you can be cited and released for a misdemeanor and not cuffed if the officer sees no need to transport you to the local jail. My former department had a policy that we cuffed all arrestees that we transported but if it is not possible it is not possible.
I would guess you were cuffed when the female was not because males are more likely to forcibly resist. I would have done the same.
There is more to this story anyway. Cars dont get searched because an occupant was fidgety. At the least you consented to the search or there was some probable cause.

True Blue made a very good point about you answering your own question. How do you handcuff three people with only two pair?!
The use of the cuffs on the male suspects for officer safety and placing the female in the backseat is appropriate. You are not necessarily under arrest just because you are handcuffed.
All three were arrested because of what's referred to as "constructive possession."
Unless the girl decides to come clean that she was the ONLY person aware of the marijuana...you ALL get to take the fall!

It depends on what kind of crime you are involved in the first place. If the person is totally violent or run it is standard procedure to handcuff the guy in order not to escape that is the main point of handcuffing a suspect/person or persons.
In the said story, why isn't she handcuff while you two are handcuff? The car where they found the weeds and the seat of that girl is immaterial for handcuffing a girl, and besides she is a woman without disrespectfully a cooperative person doesnot need to be handcuff and because of her gender I suppose most cops don't handcuff female suspect unless otherwise. Besides, since both of you are readily secure I donot think she will run away and leaving you two in the police car.

if the car is her car the weed was underneath her seat she should have been put in cuffs and no that is not fair to you or your brother here in massachusetts cops carry there regular handcuffs and plastic what looks like a big huge tie for a trash bags but you and your brother will get your day in court i totally agree with you

um, b/c they only had two sets. You just told us that. And they could probably take her out easier than you guys so they restrained you instead of her. I would have done the same. And you should break up with her. And you shouldn't want your girl to be cuffed anyway I mean by another person. You know. DON"T DO DRUGS! JUST SAY NO.

You answered your own question when you said there were only 2 sets of cuffs. Regardless of whether or not you knew the MJ was there, you were the responsible driver and you allowed it to be there possibly by reason of insanity.

Every time I have been arrested they have cuffed me behind my back. Usually I don't care what happens to the others
