NASCAR does own the numbers. They run the sport. They give the numbers to the teams. If a team stops running a number, after a period of time NASCAR can (not always, see the #3) give the number to another team. What would happen in the case of the #8 is this:
1. Budweiser, Hendrick Motorsports or someone would give DEI a pile of money.
2. DEI would tell NASCAR that they are not going to use the #8 again and apply for a new number if needed.
3. HMS would tell NASCAR that they are not going to use the #5 or #25 and apply for the #8.
4. NASCAR would grant both requests. Why would they not? It means everyone gets paid a lot of money, one way or another.

NASCAR has control of the numbers, and I guess a number cant be sold. That doesnt mean however that Jr. wont be in the #8 next year. Hendrick and DEI could make a trade, like the #5 would automatically be in the top 35 in owner points, and they would get the owner points from the year before. Some deal is being worked out. I heard that DEI and Hendrick were talking about making a trade with the numbers. I also think that Kyle Busch is going to DEI. Alot of teams want him, but hes going to go wiht the team that gives him the best opportunity. I think DEI would be good, because him and Martin are really really young, and Paul Menard, has some catching up to do, but all of these guys could be around for numerous years to come, as they are in their early 20s I think. I know Kyle is, but I'm not sure about Martin Truex Jr. or Paul Menard. I could be wrong though, as Jamie McMurray looks like he's in his 20s but hes actually I believe like 30. I was like no way. He looks really young for his age. He's still pretty good looking too.

That is true on paper. But that does not mean that Hendrick can't pay DEI and ton of money to buy something else, and DEI happen to release the number back to NASCAR at the same time. There are ways around it.
However, if Budweiser stays with DEI, they may want the #8 to stay with them. If that is the case, Teresa will have to keep it.

Good post, they can however trade the number for another with the approval of nascar. I really think since he is making a fresh start, he should have a fresh number. He has a new sponsor and all that, why driag all the old around and still have the comparisons?

nascar owns the numbers. they distribute them out to drivers on the teams. so, hms should get with dei and make a deal with nascar. jr has had that number since he started racing. i think he should be able to keep the number 8.

Yes Nascar owns the number but DEI has the rites to it and they can sell or swap it upon Nascar's approval.

I've heard rumor that Jr. is going to drive the #5 car. I remember TV comercials from last year, as a joke he was changing his number and everyone was upset. One guy was getting a haircut with # 8 and changed it to Dale's new #, one guy was trimming the hedges in his yard to his new # along with at least a couple of more people changing things to his new #,,,,,,,then Dale tells that it was just a joke. Wasn't that new # 7.5? Well, that's a little over half between 5 and 8. Already have # 6, # 7 never a 7.5. That would be unique.

HMS: 8, 24, 48, 25

you can't sell what you don't own.
I can't sell my apartment even though I have a lease on it, but I may be able to sub-lease it. I can't do that if my contract says no sub-leasing. However, I can let someone stay in my apartment regardless of a no sub-lease clause. That is seems is the situation with NASCAR numbers. The owners lease the numbers and there is a no sub-lease clause but if an owner wants to they can let another owner use the number for a year

Nascar owns the #s?? i thought the teams did.. and the owners can swap #'s with approval of Nascar if Nascar owns them..i also heard Bud was willing to pay the big$$ for him to keep the # and sponser rites
