I am serving as a juror on a civil case in california. it seems like we can not deliberate. We are at 8 to 4, we need 9 to 3, and tomorrow we may be a hung jury! because we already ask the judge's advise and went back in the deliberation room and tried one more time, and we still can't get to change one person's mind. I like to know what happens to the case, will it be canceled or do they try to pick another group of jurors and do every thing allover again. pleaes if you know california's law in this respect please answer me asap. thank you in advance.

If you are a juror, your posting here violates the judge's instructions to you. You should not be seeking answers outside of the court, nor should you be discussing the case outside of court.

Don't worry about it, your job is hear evidence and make a decision based on the evidence and the applicable law. You don't have to worry about what happens next, it sounds to me like you have become emotionally invested in the outcome of the case and that could be effecting your opinion. Just use logic and make a good decision, what other jurors or what will happen is none of your concern.

David B is correct. This is very serious juror misconduct, and could jeopardize any verdict you might reach. What happens in the future is of absolutely no concern to your deliberations, and you should not even be asking the question.

Deliberate again so that a majority ruling will be reached.
