in nj, the legal implication is leaving the scene of a traffic incident, which can be very serious. the question for you is how far do you want to puch this? if you file a complaint with the cops, they are duty bound to investigate and take it to a prosecutor. if you decide to ahndle the family issue without the cops, you may face an allegation of filing a false report if you try to stop the investigation/prosecution. decide beforehand how far you want/need to go, because once you pull the trigger on this one, there is no going back.
also, consider that you may be at the heart of something very dangerous in your family. hitting someone with a vehicle means the violence escalated very far very fast. you might want to consider some counseling on that one...

Assault. If the person driving legitimately did not know that there was someone in the way. If the person did then yes felony hit and run. Possibly aggravated assault. Or depending on the circumstances, attempted murder.

If your husband did this, it was not an accident. It was attempted murder. Next time he might be successful. He should be in jail and the victim should be in counseling to see why they allow themselves to be treated like this.
Over the weekend at least two men were arrested for murder. One for killing his pregnant girlfriend. The other for killing his wife and kids. I'm sure there were many more which did not make the headlines. Rethink your life and rethink your options.

Leaving the scene of an accident compounds penalties greatly. Telling a judge you didn't know is an insult.
Add the fight component - and you may already have warrants out for you.

If it is real "hit" and "run", it is against the law. Lot of it depends on circumstances (who provoked whom on what grounds), your own testimony. Prosecution also depends on how busy the police is and how busy District Attorney's office is, how long did it take place, how many witnesses, etc.

dont matter if you provoked it, its an illegal act. they hit you, they ran.. common sense, you can go for a civil action law suit and sue them for pain, suffering, or emotional damaged depending on your state.
but if you were in Oregon per say, and a family memeber accidently hit you in an arguement with their car.. they would be followed, pulled outta there cars, and whacked the **** outta um, just like they did you.. family law is funny, and eye for an eye in my way of thinking :)
