well, him shooting the baby/fetus would be the same as the doctor killing the baby/fetus wouldnt it? and they dont put doctors in jail for it...but yes i could understand him being arrested not for killing the baby but for attempted murder of the mom.

If the fetus was along enough to be viable,he could be charged with 2nd murder,but then she wouldn't have been on her way to an abortion clinic since the fetus would have been too old for the before-viability standard. In legal terms the two circumstances could not coincide unless we legalize late-term abortions.

The abortion hadn't happened, so yes, he should be charged with murder. She could have pulled out at anytime before the procedure.

I'd say yes. Who's to know what might have happened. That mom may have changed her mind.

..I am sure he would be. If a pregnant woman is murdered and the baby dies as well, it is considered two murders...doesn't make sense.
