You have to go to the court office, and also child welfare services and apply for custody of your son. I am assuming that the biological father had his name put on the child's birth certificate. That at least he admits that he is the father. So he shouldn't contest that. The court will normally award the child to the Mother in most states. If he challenges the custody rights, then it will go in front of a judge. At that time whoever is awarded the child a certain amount of the other parties income will be required to pay for the child's welfare, and upbringing. Health care will also be an issue. He will probably be required to pay at a minimum of 50% of all medical care expenses for the child. there are some cases that judge will require one of the parents to have a health plan for the baby's protection. You will find out from the court office what more if anything is required for you and the baby. Good Luck to you both.

Is there any reason why the father can't share custody?
I assume he has a right to be the father of the child unless he is a danger to him.....
Depends on your circumstances.

Basically the courts usually award custody to the mother unless shes ruled unfit due to child or drug/mental abuse so you have nothing to worry about. Also you will get child support from him but he will get visitation rights
