To avoid the points, plead no contest (or guilty - depending on your state) and ask for traffic school. You will have to pay the fine, and pay for traffic school, but when you complete the school, the ticket is dismissed.

In Florida, you get 3 points for speeding 14 mph or less over the limit; 15 mph or more, you get 4 points. To avoid the points, take an approved driver improvement class online or at a driver school (check with the clerk of court for more info.) You can only take the class option once every 12 months.

In Colorado a basic speeding ticket is a two point ticket.

If you take the ticket to court and you are very appologetic, understanding that you did something wrong, and over all very kind to the judge, then the judge may choose to help you out by removing the points or reducing the fine. It all depends on your judge and the mood they are in though.

Almost the same thing happened to me in 1996. It was $111. fine, and I went to Comedy Central Traffic School to avoid the points. They say if you challenge it in court or hire one of those lawyers that advertise no fines, no points you usually get off. Frequently the cop doesn't show up and if you don't have repeat offenses piled up they dismiss the case.

Yeah you lose 3 points because the cop was having a bad day and wouldn't knock it down to 40.
You might want to show up for court and argue that 1mph.

yeah you will most likely get 2. if it is your first time, go to court and be respectful and dress nice, admit fault and ask for a lesser charge. the courts like people that take responsibility for their actions.
