My fiance was on a work visa and it ran out at the end of April. He had a 60 day grace period to try and figure out a way to stay.
His Mom spoke to one of the senators that works with the president and he told my fiance to stay and he would help us out and get his greencard through the system faster (it is supposed to be processed October 2008).
The thing is, we just had a baby on May 24 who is an American citizen (we are both British and I am not yet a citizen).
This senator didn't get back to us so we called and he said that he never told my fiance to stay and is calling us liars.
His Mom has already petitioned for him to stay three years ago and he can't get a work visa or anyone to sponsor him.
Now, he has to go back to England on June 30, which is only 5 days away. We have done everything right and not broken the law and nobody will help us. There illegal immigrants who are getting greencards and they dont deserve them and my family is being torn apart... is this fair??

Unfortunately, there are no witnesses to the senator telling him to stay.
However, we have wrote to them saying how upset and disgusted we are with them and demanding the senator to take a lie detector test

Why couldn't your fiancee get an extension on his work visa?
If he stays pass 6/30, he will be considered an illegal alien.
He can take that chance and stay and if get caught, he is entitled to due process, which means he will see an immigration judge, he will not get deported anytime soon as immigration is so backed up , it will probably take them at least 6 months before he sees the judge and then he will get another hearing in about a year giving him time to get a lawyer and by that time he will have his green card from his mom.
Please do not blame the senator for this.
Why didn't your fiancee do something since April, why wait until a week away from his deadline.
Why is it taking that long for his Mom petition to come through.
Try talking to a lawyer.

It's really not a question of fairness. It's a question of law. This kind of thing is happening all over the country as we speak. You're British and apparently many here sympathize with your family's plight but I don't see anybody talking about how unfair things are for the many people from Mexico going through much the same situation that you and your fiance face.
I doubt that anybody can pinpoint the time in history when somebody decided to draw the first border and began to determine who could come over to his side of the river and who couldn't. Seems like maybe there should've been a better way for us to all live on this planet in a more fair fashion. But over the melinia, more borders were drawn, more immigration laws were created and more arms were invented to enforce those laws. Or, as we have personally experienced, those same weapons have been used to cross some body's border and simply take his land under force. And if you have enough of those weapons, you get to keep the land, as is the case with the US taking Mexico's land or that of the Native American's, or if you don't have enough weapons, as we showed Saddam in Kuwait, you get kicked out.
Is it fair? When did fair have anything to do with it? Sorry for what you are going through. Hope all works out for you and your family.

Hopefully things will work out for your family. It is sad that this happens all the time to many people. I don't think you should say that you or your fiance deserve a greencard anymore than someone else that wants to immigrate here. That is why we have so many people that stay past their visa expiration dates. It is hard to leave your family behind in a situation like that.

Always, I mean ALWAYS, get statements in writing or else you will be screwed (as you know already)....especially when you talk to one of our elected officials. It's sad but true.
Does his mother personally know this Senator? Seems odd that he would verbally promise something.
Politicians do not want to be embarrassed. You can try writing a formal letter. Write down the exact time and date you talked to him, exact words he used to promise you, and your situation. On the letter, include that you CC'ed (carbon copied) the letter to your local news stations.
If he still doesn't respond, I'd contact the local media. They have segments like "Shame on you" or "On your side" where they do investigative reporting and expose dirty business owners and politicians. I'm not sure whether you have enough evidence against this Senator but it never hurts to try.

Unfortunately we have so many people filing now there isnt enough people tp process all the applications.
Definitely need this type of thing fixed.
I wish I had some answers for you. I do wish you the best and congratulations on the baby.
Do you have witnesses to the Senator saying this?
Maybe you should speak to the media?

First and foremost, congratulations!
Secondly, you are experiencing what Americans have come to expect. Be very cautious about advice you receive from politicians. My personal rule of thumb, advice not given in a written format is hard to prove was ever given in the first place.
Not to be critical, but worthy of noting is the fact that you expected to receive preferential treatment from the Senator. While many would likely take advantage of such an offer, it's a gamble. I am empathetic to the situation you now find yourself in, but your more apt to be burned when you play with fire.

Send a fax to the White House. In it, name the senator, and give the date you were given the advice. They have people there (49,000 of them) who handle these kinds of matters.
Most people don't believe that faxing the White House can work, but I have found them to be responsive and swift, the best Washington has to offer.

Obviously, it's not fair. I suppose the obvious thing to do is to stay illegally past June 30 and wait for Amnesty. Or, you could both go back to Brittain rather than splitting up your new family.
