Since your husband is a loan officer and should be familiar with RESPA, then he KNOWS it is a violation of RESPA to pay your neighbor for the referral. Tell him to give his neighbor a friendly kiss, and a gift certificate to dinner on him as his thank you.

Finder's fees, spifs, birddog fees, can be very questionable and sometimes illegal. There is probably a very straightforward policy and proceedure manual at your husband's company that address's the do's and dont's and what's a firing offense.

It sounds like your neighbor being a good friend to help.

How about dinner somewhere at your husband's personal expense. Or the lender your husband works for may have a gift program set up for acccount referrals and this may apply. Good luck and aDios

He could pay a loan origination fee to her, but that seems excessive, just thank her with dinner or something. If she wants money, tell her the really good mortgage leads cost under 50 bucks, as a loan officer, I wouldn't pay her unless she's giving me referals on a regular basis. If she can provide that, than yeah it's worth giving her something.

I would suggest a gift card to a nice restaurant, $50 or $100 tops. Anything more is unnecessary.

From what I know, it's a violation of RESPA to give a kick-back. He should just say thank you....think of it as free, word-of-mouth advertising. If he wants to be nice, then take her out to dinner.
