My son's dad gets him every other weekend and 3 full weeks out of the summer. He just came back from the first full week. Anyhow, when he left he was still on an prescription antibiodic from the doctor and his dad refused to give it to him because he is an herbal freek!!! Is he allowed by law to make that decision of not giving it to him? My son is only 8 so he has no say so in anything. just curious!!

He is allowed to refuse, just as you are allowed to give him the herbs. Medical decisions sometimes need to be specifically drawn out in custody papers. He may be just as upset that you gave the child the antibiotic. If you are that concerned, and there is no compromise, authority over medical decisions, needs to be decided by the court.

I would consult the attorney you used for the custody. If you have sole custody and he has visitation, I think that by law he has to give him the medicine. You may also want to say, "If you don't want to give him the medicine, then we will have to reschedule until he is better!" The problem with not taking a full course of antibiotics, is that your son can build up an immunity to them, and then a time he may really need them, they won't work.

it depends do you have joint custody or do you have custody and he has visitation. if you have joint custody he has the right to give him herbal remedies. but if he has only visitation he does not have the right to change anything you make all the decisions. the person with custody gets to make all decisions regarding school and medical. but with joint custody you both make those decisions. but if he was already on the medication he should have finished it because that is how drug resistant strains of diseases are started. so if he gets sick with dad and dad starts an herbal remedy mom should finish it and if he gets sick with mom and mom starts antibiotics dad should finish it. you two need to sit down and talk over things like this it is important that you work together for your son.

Actually depends on how your child custody agreement was written!! If, in his 3 weeks he has sole medical discretion then he was within the law to not give it to him. If now, then there is a problem. You need to remedy this situation asap! It may come down to when the child is on medication, then visitation will not take place until he is better.

no he cant do that get that child back to the doctor and dont allow the father to have him til hes off of the medicine. stopping the meds before they were finished was dangerous and stupid. now you need to go back to the doctor and restart treatment from square one and report this to your social worker

No he can't stop medications (especially antibiotics) that is child endangerment.
