is being chased by the police but refuses to pull over,crashes his car into a tree,minorly injuring the passenger,fleas the scene of the accident and run from the cops and who waits a few days after before tuning himself in?

The ONLY saving factor in all of this is his ultimately turning himself in. But the fact he waited so long to do it won't help his case. (Assuming his name isn't Ted Kennedy. If it is, all bets are off.)

I dont know about your state but In Michigan if you run from the cops you do mandatory time fleeing to elude the police is a felony because of the high number of deaths each year from car accidents from the police chasing people, and leaving the scene of a injury causing accident is pretty bad also , that would probably just get bad probation but Im sure the person turning himself in will tip them off to the fact they were chasing him and he will get time in jail for that, running from the cops is a giant mistake.

It should be death at the hands of a group called Mothers Against Drunk Drivers. MADD is an organization begun by people who have suffered far too much loss because of this kind of irresponsibility. May a good long time in jail or prison and restitution for the property damage cause your friend to stop behaving like a fool.

Here are some crimes he can be charged with: Fleeing/Evading in the First Degree (1 to 5 in prison). Assault in the Second Degree (10 to 20 in prison). Wanton Endangerment in the First Degree (1 to 5 in prison). Leaving Scene of Accident (12 months in jail). Turning himself in will have no bearing on the charges.

In Ontario Canada this person may be charged with:

*Impaired driving
Dangerous Driving causing bodily harm
Flight from police/fail to stop
Failing to remain at the scene of an accident
Fail to report accident

Arrested for above offences, and if convicted a short jail term (or house arrest, yes that happen in Canada for these kinds of offences) even if it is a first offence.

*The impaired may be hard to prove if there are no witnesses to his/her drunkenness and no breath test, but all the other charges would apply.

Sounds like a vacation at the expense of the taxpayers, time dependent on arrest record.

Lucky it was a tree and not a lady with a baby carriage.

They will vary in different states. Why not just pull over and refuse to blow. It is irrelevant that the passenger was also drinking.

in my state, fleeing a personal injury accident is a felony.

if the injured passenger testifies they were both drunk, conviction on DUI is very likely as well.

If this is you or a loved one, hire an attorney.

Otherwise, turn him in.

failure to stop for blue light, reckless driving involving bodily injury and felony d.u.i...and possible resisting arrest for running best bet is to let them stay there until their court date so they can start the sentence now... when their court date comes up they may get released on time serve

If he gets a good lawyer very little would come of it. There are just to many ways out of it.
