German Shepherd dog. Dog came from California. I lived in Nevada at the time of purchase. I got him at the end of May this year.

The seller states the dog was not list as "trial basis". Do I have any legal rights? He is nipping at my children. He is an unfixed male and I have an unfixed male standard poodle.

If the breeder won't take the dog back, you did not buy it from a hobby breeder, you bought the dog from a backyard breeder. There is a big difference. The backyard breeder is out to make a buck and he did. He knows he can't sell and older puppy, so of course he is not going to take him back. You have no legal recourse that I'm aware of in either state.
Buying a dog is really a buyer beware situation.
If the dog is actually biting the kids, no rescue is going to touch him. It would be a legal liability for them. If he is just nipping the kids, you may find a GSD rescue group or an all breed rescue group that may take him. Check www.petfinder.com to find rescue groups near you.
Rescue groups will not place and intact dog, so you either need to neuter him or give the rescue the money to neuter him. If you don't, they may or may not take the dog.
Next time do more homework before getting a dog. Only buy from a responsible breeder. You will get a contract, you will be interviewed, your home will be inspected. There is a good chance such a breeder would not have sold you a dog because they would have known a GSD was not right for your family.
This breed needs lot of training, lots of time, lots of exercise.

certain things you should take responsibility for. you choose this dog and it's your job as an owner to step up. he's nipping this is common in any dog and should've been expected on your part. dogs can easily be trained not to nip at people. also get him fixed before your two dogs start going at it since you didn't say how old the GSD was.
even still you should read your contract and see what the breeder's policy is on returning dogs. don't expect to get your money back because there doesn't sound like there's anything wrong with him. also expect to pay for all traveling expenses. if you don't have a contract or it's not stated in the contract get in touch with the breeder. if you can't get in touch with them than you probably bought from a backyard breeder
no you do not have any legal rights except to the dog. you are now stated as it's owner. the only legal rights you would've had would be if the dog is ill and he's not

Teach him that humans are boss, not him. By what you have described he seems to have a very dominant nature.
Why is it that as soon as an owner sees a problem the answer is to return it? Over 50% of dogs are in shelters because owners don't want to work with there animals and or because they do not fit the household.

well this is for sit get a piece of dog food put it in his face then pull it up high and say sit if he jumps push him off and near his tail but on his back push it then keep doing it until he learns and also umm if he jumps on people push him off then hit his nose but he probably wants to play if you don't have any chew toys go buy a few and you shouldn't return him just because he act different just buy a baby gates if you have a hall or buy a little fence at petco or petsmart so he can play

sounds like this wasnt a very good breeder if he wont take him back!
First step is to get both dogs neutered!
Nest step is to get some training or hire a behavoirist.
If you really insist on not keeping the dog, you can go to www.petfinder.com and take him to a shelter or try a rescue.

What do you mean by 'not getting along' with your family? Training classes may help you with behavioural problems. When you take on a pet you take on the responsibility of caring for that animal.

You didn't give much information on his behavorial problem, but it sounds like you're stuck with him or her. The dog may think he or she is the "alpha" (boss dog) and your family is its pack. Patience and training might be the first steps I'd consider.
