speeding. I was just wondering if this is the proper protocol and procedure for a female officer to act in this situation when dealing with a male. Can this be considered sexual assault? Possibly this can be considered for a reason to have this charge dropped? Thank you very much

Her patting you down and you allegedly committing an offense are two different things. on its own, it wil not be enough to have the charges dropped, unless the patting down was unconstitutional (even if it had been carried out by a male officer).

Exactly what did you find objectional? I mean, was it that you found being patted down objectional, or that you felt uncomfortable with the officer's behaviour (i.e. that the pat-down was understandable, but that the officer took advantage of you in performing her job), or both. Did you find her touches to be inappriopriate? If you are saying that because she is a female and you are male, she should not have frisked you, and you are only suggesting this to get the charges (whatever they are) dropped, then your chances may not be very good (depending on the lawyer you get, of course).
As far as just the frisking goes, it depends on the state. Very recently, in Massachusetts, the Supreme Judicial Court (the highest court in the state) ruled that an officer can frisk even a pedestrian if they suspect a danger to the public.
If you feel or can show that the officer did not should not have frisked you, and that her reason for frisking you was in a sexual way, then you may have a case, both criminal and civil. The charges being dropped may go right along with that.
Other questions that you must consider was whether the officer informed you that you would be frisked, and whether she asked or informed you or otherwise gave you an opportunity to have a male officer perform the pat-down, and whether or not you said anything before or during the pat-down to indicate that you were uncomfortable with this. If you did not, this doesn't mean that there was no sexual assault, but a shrewed lawyer would likely be all over that, and link this directly back to the accusation being only to have the original charge against you dropped.

If male cops can't pat down females , than why should a female cop be allowed to frisk a male? Just because they're dykes doesn't mean they can act as a male officer. File a complaint. I would and so would any girl that got frisked by a male cop.

well sexual assault would involve penetration of the mouth anus or vagina. so i don't think you want to file that. now you later say that "can this be considered for a reason to have this charge dropped" meaning you were arrested. so there had to be some subtle probable cause in the mist of your sexual assault that the police officer smelt, saw, or was told. thereby allowing her to sexually assault you.

This sounds like a pat down for officer safety. You're not providing enough information. If you're asking if a female officer can search you, of course she can. I pat down males and females, our female officers also pat down males and females.

Well all I know is that when they pull over a female and have to paddle her down they have a female cop do it. They should have had a male cop do that to you. I would think..

I would personally have enjoyed this female cop to pull me over and padded me down. Unless your gay or something. I would have asked her if she wanted to play good cop and bad cop with handcuffs.
