i was sitting in my car on the curb, outside of my house, the car was on, i had no seatbelt on.

Well, the vehicle was in operating condition, not parked. Normally a cop would just remind you, but if you got smart with him he probably would ticket you.

So what is the problem? The law states, that you must wear a seat belt while driving. If the car was in Park, that is not driving. If you are not in traffic, that is also not driving. If the car is not moving that is also not driving. Understand?

In the state of California, if your keys are in the ignition, you are legally driving. If the police walk up to your car and you are drunk and the key is in the ignition, but engine turned off. it is still considered as drunk driving.
This sounds to me like one of those anal laws designed to work against the citizen.

I think you have to be moving to get a ticket.
