Around 3 months ago I was on drugs working at walmart and had my drug dealer come into the store and give me a few dollars at the register acting like he was purchasing a giftcard for 300.00, I got busted, at first denying it and after seeing the video for myself and told that if i didnt tell the lp (loss prevention) personel the truth that he would call the cops, which was also a big no no due to me having a warrant for failure to pay fines for driving on a suspended license, admitted everything, at that point the lp tells me the cops are on there way and that incase he didnt mention it I dont have to stay and wait that im free to leave but that id probably not make it out the door and if i did that the cops would come to my house and get me, well I left and now three months later the cops showed up to arrest me at my home, I was not there, but talked to the detective and was told that if I promised to meet him and discuss the matter he wont arrest me? I know what I did was wrong ???

I want to rectify my actions and do what's right, I have since got off drugs, got a new job, a really good job, and am able and willing to pay walmart back, but if I end up going to jail I not only risk loosing my job but also loosing my 9yr old son, I've never been in any troulble before except for the traffic violation, and im scared out of my mind that this is just a setup to get me arrested, please help!!! Thank You

The detective told me to try to take care of the traffic warrants before I came in, and that he is giving me his word that he will not arrest me, even cuff me in hand cuffs and that I will be able to go home if I come in for about 25mins to talk to him???

While it is true that cops can and will lie to solve crimes I doubt that is the case here. I would never "give someone my word" in the matter you have described and then break that promise. This will quickly give an officer a very bad name and he will never get any cooperation or good information out of anyone. I would and do lie to try to solve a crime but would not do so in the manner you have described the exception to this would be to apprehend someone that I felt was a real danger or a flight risk for a major crime. For what you are talking about that would not be the case and it sounds like the detective will happily trade off not arresting you for the chance to finish up his investigation.

As another poster has said the detective may be saying that he will not arrest you on that particular drug charge however if you have active warrants he may have little choice but to arrest you on those if you do not have them taken care off. Also this being a drug case it is quite possible that the detective is hoping that you will cooperate and maybe give some good information that can be used to charge others.

So no I do not think this is a setup, it is possible but not likely. No matter what you need to get this taken care off. Say by the off chance this was a setup and you were arrested at least it would be more or less on your terms. What I mean is you would not have to be constantly worrying about being arrested at home, at work, on the street, on the way to dinner, with friends or family, etc.

Well, if he says he won't arrest you, he probably won't for the walmart incident.

However, you do have those warrants, so they might hook you on those and make you post bond.

Best advice would be to go meet the detective. You obviously know drug dealers, so maybe he wants you to work with him to catch bigger fish, in exchange for not charging you with the walmart stuff.

You need to get all this stuff cleared up ASAP. Last thing you need is to get fired from the new job because you got pulled over on the way to work and had to miss a day because you were in jail on warrants.

You have two ways to deal with the detective: (1) you can cooperate, in which case things will probably go as he described with you being able to turn yourself in; or (2) you can be uncooperative, and he will come to your house and arrest you.

What is the worst thing that could happen that you don't want to happen? What can you do to avoid that bad thing happening?

Take care of the traffic warrants and turn yourself in. Don't risk the humiliation of being taken from your home or new job in handcuffs.

Think back to exactly what he said.
Did he say he would not arrest you at all or that he would not arrest you for the drugs?
He wouldn't have to arrest you for the drugs - just question you for your statement. DA's like to have a suspect statement. But he could arrest you for the warrants without lying to you [depending on what he promised]. Many times I have taken statements based on a promise not to arrest the suspect for that particular crime knowing I was going to arrest on an outstanding warrant. Plus, if he gets you to volunteer a statement, if you come to him, you are not in custody so he is not required to give you a Miranda advisement.
If it a legal ploy to get a statement? Could be. But it legal & accepted in court.

You might as well go meet him. Yes, he will arrest you. Even if he only wants to interview you about your criminal activities at work, you still have outstanding warrants and will be taken into custody. He came to your home once, he will show up again. Just go get it taken care of and move on with your life.

Do your self a choose and don't refer to the detective except your lawyer advises you to. in the event that they had probable reason then they could have arrested you already. What he needs is to get you to declare some thing incriminating. purely politiely tell him if he questions you which you elect to not answer any questions without your lawyer or except your lawyer advises you to. in case you rather are harmless, then enable him to inspect you. whilst you're telling the fact, enable him to determine that out. yet be well mannered because of fact in case you disenchanted him he would be liable to choose to get lower back at you. So be well mannered and don't refer to him without the advisement of your lawyer.

Just get it over with.. Once it is over you can go on with your life. You don't want to be looking over your shoulder for the rest of your life, besides, the longer you wait the worse it can get.
