What's the age difference?

In California it's a "wobbler" meaning it can be prosecuted either as a misdemenor or felony. The cut-off is 3 years, meaning if the suspect is three years or older than the victim, it is a felony. Under three years is a misdemenor.

A misdemenor can be prosecuted by a fine, and up to one year in a county jail. A felony can be prosecuted by a fine and at least one year or more in a state prison.

It depends upon the age of the "girl/victim". It could be classified as rape, if she is under a certain age, which may vary by state. It could also mean that the offender will have to register as a sex offender, again depending on age.
In Arkansas, depending on the age difference, it could be as much as 10 to 40 years to life.

The kid in Georgia got 10 years. Probably no more than 7 years with a good lawyer. Of course that is if dad does not shoot him.
