Whether the deceased has UM coverage is of no consequence to your friend. Your friend, if found liable, can be sued for several hundred thousands of dollars, and depending on the age, occupation, marital status...maybe millions. Any assets she has now, or may acquire in the future, can be garnished. If your friend is not the registered owner of the car, whoever that person is can be held responsible as well.

And people say insurance is a scam....this is one of the MANY reasons why you have insurance. If I were your friend though, I'd start looking for a criminal defense attorney b/c she could very well be charged with vehicular manslaughter/homicide if the cops find her actions violated any number of motor vehicle codes. She should also find a civil attorney to discuss this case with b/c chances are a wrongful death suit will be filed.

The family is covered by uninsured motorist on their cars which has nothing to do with her. She most likely will be found at fault for driving without insurance which is illegal, so whether the lady was right or wrong, your friend should not have been on the road at all which will make it her fault. Sorry but thats how it will turn out. She should get a lawyer because the family of the woman is probably going to file a suit.

That really all depends on who was at fault. If the investigation is ongoing then they have not decided who was at fault. If she is at fault they can charge her with vehicular homicide. The family can sue her for a lot depending on what the findings are and how old the person was, if he had young children etc.

Wow, im sorry this happened.

If his insurance feels shes at fault.. with a death involved... seriously the skys the limit....you may want to consider a lawyer at this point or if you receive a demand letter.

Well, it really depends on who will be at fault as well as many others. Unfortunately, your friend may have to claim bankruptcy after wards. But things may not be so bad depending on their age.

You may want to prepare your friend to serve sometime in jail if she is found at fault.

It is all sad and unfortunate.
