if you get pulled over with passengers and the officer has probably cause to search the VEHICLE (for example he smells marijuana), does that probable cause also apply to searching your person? i.e. your pockets? what about passengers?

If an officer has probable cause to search a vehicle, and he finds any narcotics in the vehicle than anyone in the Vehicle is subject to arrest and search as everything in the vehicle's interior is with in "wing span" of all passengers.

Its the law.

Yes, the Officer may search Everything in the car, including you, passengers and Even Fifi...

The idea is Mobility versus stationary searches; with PC and a car the search must be made quickly and no warrant is required; a home is different and a warrant is required and all areas to be searched stipulated within the warrant.

If the officer has probable cause, he can search the car, any containers within the car, and any passengers.

If you are being ARRESTED the cope has every right to search your person. If you are not being arrested the cop has a right to conduct a PAT DOWN FOR OFFICER SAFETY. If the officer finds the marijuana and you are considered to have been in possession of it, chances are you are going to be arrested and searched.

Yes, if he has probable cause he can search everything and everyone. The marijuana could easily be in someone's pocket, couldn't it?

Yes he does, the smell of marijuana gives him the probable cause to searcj for it, that includes everyone inside and any containers or bags that are in it.

Man freedom really is dead I can't believe you call yourselves Americans. I quit smoking everything at 17.
some of my friends smoke occasional marijuana.
when I was about 22 I got pulled over by a police officer. for passing lane violation. simple traffic offense. no one smokes in my truck. the police thought otherwise (Stereotyping) asked to search the truck I said no we were on are way camping to go caving. the officer forced me out of the truck and hand cuffed me and proceeded to search found my friends marijuana. he cop-ed to that being his. the officer gave him a ticket for possession, as well as me I objected to being charged for something not mine and refused to sign the ticket.He threatened to take me to jail.so I cop-ed under duress. My friend took the plea paid the fine. I took it to trail Case dropped cop never turned in evidence because he smoked it.
